Animal Lovers' Choice Awards Voting Rules and Terms

This is a binding contract. Your continued participation as a Voter in the Awards in any manner, signifies your acceptance and agreement to these Terms and Conditions. We may cancel or amend these Awards Terms and Conditions without prior notice. These Terms and Conditions were last updated on 24th December, 2024
These rules govern what claims you can bring, what damages you can claim, and how disputes between you and the Operator relating to your participation as Voter (collectively, a “Participant”) in the Award will be resolved.
Throughout this document, the terms "We," "Our," "Us," and any other similar pronouns or expressions shall be used interchangeably to refer to the Operator and shall be considered to represent the Operator as a whole.
Please note that the disclaimer of warranties, limitations of liability, and governing law, waiver and dispute resolution sections contain important limitations on our liability and our agreement to arbitrate following the laws of New Mexico only.
Welcome to the Animal Lovers' Choice Awards (“the Awards”)! Voting for your favorite pet-loving celebrities helps support a great cause, so make sure to read through these guidelines before casting your votes.

1. Voting Period
Voting opens on Friday, December 27, 2024, at 8:00 AM EST and closes on Friday, March 7, 2025, at 5:00 PM EST.
Votes cast outside this period will not be counted, so be sure to get your votes in on time!
The Operator reserves the right to change the Voting Period dates at it absolute discretion.
2. Eligibility Requirements
Minimum Age: Voters must be at least 13 years old to participate.
Location: Voting is open to USA residents (unless restricted by local regulations).
3. Voting Costs and Structure
Voting Tiers and Costs: Each vote has a cost, and pricing is outlined on the official website. Different voting tiers may allow you to cast multiple votes at a time.
Charitable Contribution: a minimum of 50% of proceeds from all voting fees will be contributed by Operator to Best Friends Animal Society to help animals in need.
Pricing Changes: The Operator reserves the right to update the pricing structure as needed. Be sure to check the website for the most current rates.
4. Voting Model
Free Voting Option: You can vote free once per 24 hours and you can select one celebrity per award
Paid Voting Option: Votes can be purchased an unlimited number of times.
All Sales Final: Please note that once votes are purchased and submitted, no refunds will be issued.
5. Supplied merchandise
Merchandise: Any merchandise available to voters for a single transaction vote bundle purchased above a specific value will be clearly marked on the vote form.
Only US: Merchandise is only shippable to addresses within the USA.
Shipping Address: Voters who are eligible to receive gifted merchandise must supply a valid shipping address
No Responsibility: We are not responsible for delivery to incorrect shipping addresses supplied by the voter.
No refunds or returns: Refunds or returns of merchandise will not be accepted
No Redeemable value: Merchandise is not redeemable for other items of equivalent value or cash
Delivery timeframe: We will endeavor to ship any gifted merchandise within 30 days of the completion of winner announcements using standard postal delivery methods.
6. Payment and Transaction Processing
Payment Methods: Voting transactions can be completed using major credit and debit cards through our secure payment processor, Stripe, Inc.
Accuracy of Payment Information: Please ensure your payment details are correct. Votes cannot be counted if the payment is incomplete or fails to process.
7. Voting Platform Access
Voting is conducted exclusively on our website, www.animalloverschoiceawards.com.
Platform Availability: While we do our best to ensure that voting is available at all times, the Operator is not responsible for any technical issues that may prevent access or voting.
8. Privacy and Data Collection
All data collected from voters and visitors complies with data protection laws, including California Consumer Protection Act (CCPA), and data will be subject to the privacy policy at this location: https://bestfriends.org/privacy-policy
9. Encouragement of Fair Voting Practices
We want the Awards to be fun and fair for everyone! Please avoid using automated voting tools or methods not approved on our site. Help us keep the voting honest!
10. Prohibited Conduct
No Automation: Automated, bot-based, or fraudulent voting methods are strictly prohibited.
Violation Consequences: Any detected use of automated tools, or fraudulent methods may lead to disqualification of votes and banning from future voting opportunities.
11. Determination of Winners
How Winners Are Chosen: The nominee with the highest number of verified votes in each category will be named the winner.
Final and Binding: All voting results are final and binding. We reserve the right to verify and adjust vote counts if irregularities are identified.
12. Modifications to Voting Rules
Right to Modify: The Operator may update these rules or make adjustments to the voting process in response to technical issues, suspected fraud, or legal requirements without notice.
Continued Participation: By continuing to vote, you agree to any modified terms. Updated terms will be available on the official website.
13. Acceptance of Terms
By casting a vote, you confirm that you have read, understood, and agreed to these rules and terms.
We encourage you to periodically check the website for any updates to the voting terms, especially regarding eligibility and costs.
14. Best Friends Animal Society Disclaimer
Limited Role: Best Friends Animal Society (BFAS) is the designated charitable beneficiary of the Animal Lovers' Choice Awards and receives proceeds from voting fees.
Purchasing votes: does not qualify as a donation to BFAS by any voters. Therefore, for avoidance of doubt, vote purchases are not tax deductible.
Minimum Allocation: BFAS receives a minimum of 50% of the Net Voting Revenue. Net Voting Revenue is the cost of your vote or bundle minus 1.7% and an additional .30 cents per transaction for processing fees, subject to change based on Stripe, Inc.’s current fees. Note that the transaction fees are subject to change if international credit cards are used.
No Influence on Voting or Results: BFAS does not participate in or control the voting process, the determination of winners, or any decisions regarding nominees or categories. BFAS is not responsible for vote counts, vote verifications, or final outcomes.
No Responsibility for Award Results: BFAS has no responsibility or liability for any issues arising
from the voting process, technical malfunctions, or the

15. WAIVER AND LIMITATIONS OF LIABILITY
PARTICIPANTS (TO INCLUDE VOTERS) AGREE THAT, IN NO EVENT, SHALL OPERATOR, PROMOTION ENTITIES, TECHNOLOGY PROVIDERS, APPLICABLE CHARITIES, AWARD SPONSORS, OR ANY PRIZE PROVIDER (COLLECTIVELY THE “AWARDS ENTITIES”), WHICH INCLUDES THE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS OF EACH, BE LIABLE OR OBLIGATED TO AN NOMINEE, VOTER, WINNER, OR ANY THIRD PARTY IN ANY MANNER FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES OF ANY KIND IN ANY WAY RELATED TO THE AWARDS, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT PRODUCT LIABILITY, OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGES IN ADVANCE, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES AND ARBITRATION COSTS. THIS SECTION SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND NOTWITHSTANDING THE FAILURE OF ANY LIMITED REMEDY.
ALL PARTICIPANTS RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS THE AWARDS ENTITIES FROM AND AGAINST ANY AND ALL LIABILITY, WITH RESPECT TO, OR IN ANY WAY ARISING FROM, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, THIS AWARDS, PUBLICATION OR USE OF THE SUBMITTED ENTRIES, NOMINEE NAMES AND LIKENESSES, AND/OR ACCEPTANCE, USE, MISUSE, LOSS, OR MISDIRECTION OF THE PRIZE, INCLUDING LIABILITY FOR PERSONAL INJURY, DEATH, DAMAGES, OR MONETARY LOSS. BY PARTICIPATING IN THE AWARDS, PARTICIPANTS FURTHER AGREE TO RELEASE AND HOLD HARMLESS THE AWARDS ENTITIES FROM AND AGAINST ANY CLAIM: (A) OF AMBIGUITY OR ERROR IN THE AWARDS, THESE TERMS AND CONDITIONS; (B) RELATED TO LOST, LATE, INCOMPLETE, OR MISDIRECTED ENTRIES OR VOTES; (C) FOR INJURIES, DAMAGES OR LOSSES (INCLUDING DEATH) OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, USE, LOSS, OR MISDIRECTION OF ANY PRIZE, OR PARTICIPATION IN ANY AWARDS-RELATED ACTIVITY OR PARTICIPATION IN THIS AWARDS; (D) FOR COPYRIGHT INFRINGEMENT OR VIOLATION OF THE RIGHT OF PUBLICITY BASED ON USE OF THE ENTRIES BY OPERATOR; OR (E) DUE TO ANY ERROR IN THE OFFERING OR ANNOUNCEMENT OF ANY PRIZE.
PARTICIPANTS FURTHER AGREE THAT ALL DECISIONS OF OPERATOR SHALL BE FINAL AND CONCLUSIVE ON ALL MATTERS RELATING TO THE AWARDS AND THAT THE AWARDS ENTITIES ARE NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE ENTRY INFORMATION, HUMAN ERROR, TECHNICAL MALFUNCTION, FAILURES, OMISSION, INTERRUPTION, DELETION, OR DEFECT OF ANY TELEPHONE NETWORK, COMPUTER ONLINE SYSTEMS, COMPUTER EQUIPMENT, SERVERS, ACCESS PROVIDERS, OR SOFTWARE, INCLUDING ANY INJURY OR DAMAGE TO PARTICIPANTS OR ANY OTHER PERSONS’ COMPUTER RELATING TO OR RESULTING FROM PARTICIPATION IN THIS AWARDS, INABILITY TO ACCESS THE ENTRY WEBSITE OR ANY PAGES THEREOF, THEFT, TAMPERING, DESTRUCTION, OR UNAUTHORIZED ACCESS TO, OR ALTERATION OF ENTRIES.
PARTICIPANTS ACKNOWLEDGE AND AGREE THAT OPERATOR DOES NOT MONITOR FOR OFFSITE ACTIVITY AND IS IN NO WAY RESPONSIBLE FOR MANAGING OR CONTROLLING OFF-SITE ACTIVITY VIA SOCIAL MEDIA AND/OR OTHER THIRD-PARTY PLATFORMS, INCLUDING BUT NOT LIMITED TO NEGATIVE AND DISPARAGING CORRESPONDENCE BETWEEN NOMINEES AND VOTERS, OFFSITE VOTE INCENTIVES, MISLEADING OR DECEPTIVE PROMOTIONAL TACTICS, OR ANY OTHER BEHAVIORS CONSIDERED TO BE MISLEADING OR UNSPORTSMANLIKE.
16. DISPUTE RESOLUTION AND MANDATORY ARBITRATION
You and Operator agree that any dispute or claim arising out of, or relating in any way to, the Awards, your participation in it, these Terms and Conditions, including all issues concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, Voter rights and obligations, the rights and obligations of Operator, or the extent of any waiver or release of claims by you, shall be settled by binding and unappealable arbitration administered by the American Arbitration Association, by operation of these Rules, in accordance with its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. All arbitration claims must be brought in your individual capacity, and not as a plaintiff or class representative or member, or otherwise on behalf of others, in any purported class, collective, or representative proceeding.
Claims shall be heard by a single arbitrator. The place of arbitration shall be New Mexico, unless otherwise agreed to by the Parties, or is determined by the arbitrator that the arbitration proceeds virtually (by videoconference). The arbitration shall be governed by the laws of the State of New Mexico. Each Party will, upon written request of the other Party, promptly provide the other with copies of all relevant documents. There shall be no other discovery allowed. Hearings will take place pursuant to the standard procedures of the Consumer Arbitration Rules, although the Parties can appear in person, by video, or telephonically. The standard provisions of the Consumer Arbitration Rules shall apply. The arbitrator will only have the authority to grant any remedy, relief, or outcome that the Parties could have received in court, except injunctive relief. In addition, the prevailing Party will be entitled to recover its attorneys' fees and arbitration fees and costs. Except as may be required by law, neither a Party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder, without the prior written consent of both Parties.
If any part of this arbitration provision is deemed to be invalid or unenforceable, then the remainder of this arbitration provision shall remain in full force and effect and shall be construed in accordance with its terms as if the invalid or unenforceable provision were not contained herein.
The Awards are run and operated by Entertainment Gang LLC (“the Operator”) and Buzz Box Video Pty Ltd, trading as Launchpad6.
